Terms and conditions.

You are registering to participate in an event of KEEP ON RUNNING NV, with registered office at Westpoort 68, 2070 Zwijndrecht, VAT BE 0817.545.494, hereinafter "KEEP ON RUNNING" or "the organizer".

Participant means the natural person who has registered for an event of KEEP ON RUNNING in a manner permitted by these general conditions.

Article 1. Registration

The participant hereby declares to be min. 18 years of age at the time of registration or to have the permission of their legal guardian to register for the event.

Registration is valid only if the registration form has been filled out completely and truthfully, the registration fee and payment for extras has been paid in full, and these terms and conditions have been accepted. The

Article 2. Right of Withdrawal

The registration falls under the services referred to in Art. VI, 53, 12° WER for which the right of withdrawal is excluded.

In case of non-participation for any reason, no refund of the registration fee and any extras can be claimed.

Article 3. Cancellation of the event - force majeure - liability

General

KEEP ON RUNNING shall only be liable for a shortcoming attributable to it, insofar as this liability was not expressly excluded or limited in these general conditions. In any event, the total liability of KEEP ON RUNNING is limited to compensation for direct damage (excluding indirect damage) and can never exceed the value of the service provided, being the registration fee.

Liability in case of force majeure is excluded. Force majeure is defined as any circumstance beyond the control of KEEP ON RUNNING, which (even temporarily) prevents it from performing its obligations in full or in part. This shall include (non-exhaustive), failure or late delivery or errors by suppliers or other third parties engaged, weather conditions (such as extreme heat, storms, storms, squalls, floods, etc.), fire, riot, war or threat of war, insurrection, epidemic, pandemic (such as COVID-19), state of quarantine, disruptions in a (telecommunications) network or connection or used communication systems, disturbances on the public road, blockades, strikes or lockouts, demonstrations and other disruptive disturbances.

Cases of force majeure do not entitle you to any refund of the registration fee or other

form of compensation.

COVID-19

COVID-19 is a highly contagious virus that can lead to serious illness and death. An inherent risk of exposure to COVID-19 exists in any public place where people are present. Attendance at the event is entirely voluntary and at the participant's own risk, and implies acceptance of the risks related to exposure to COVID-19 or any other infectious disease, which is defined as any disease caused by an infectious and/or toxic substance that occurs through direct or indirect transmission of this substance by an infected person or other living organism or by property. The organizer is not liable in case of contracting infection by COVID-19 or other disease as a result of participation in or presence at the event.

In case the organizer cannot allow the event to take place due to epidemic or pandemic (such as COVID-19 and any new outbreaks thereof) and/or urgent governmental measures ("force majeure"), the registration will be automatically transferred to the new date or to the next edition of the event.

Cancellation

In case of cancellation of the event by KEEP ON RUNNING, outside of force majeure cases, the tickets will be exchanged for tickets for a new/next edition of the event or another KEEP ON RUNNING event. Any other costs incurred in connection with the event, such as service and administration fees and any extras (such as merchandising, T shirts, training schedule, charity,...), among others, will not be refunded.

Article 4. Participation

Participation in the event is by the participant personally. It is not permitted to pass on the registration.

Participation in the event is possible only with a valid registration and if the following age requirements are met:

Walking events

Participants under the age of 12 can only participate when accompanied by a person over the age of 18.

From 25 km: minimum 12 years at the time of participation From 50 km: minimum 16 years at the time of participation

Running events

From 10km: min. 12 years at the time of participation From 21km: min. 16 years at the time of participation From 42km: min. 18 years at the time of participation

The participant will always respect the environment. The participant will watch over his own safety and that of the other participants. Participants must follow the instructions of the organizer, medical teams and police.

The organizer reserves the right to exclude from participation participants who do not respect the provisions of these general conditions or pose a danger to themselves or third parties.

Article 5. Prizes

The prices stated are always expressed in euros and include VAT, unless expressly stated otherwise.

Article 6. Payment

The participant must always pay in advance, upon registration, the full amount of the registration (registration fee and extras) and this through the provided online payment system.

KEEP ON RUNNING believes to have taken all possible and relevant precautions and thus acts as a normal and careful online seller. Therefore, any theft cannot be held against it.

Article 7. Cancellation Policy

Entries can be cancelled in writing at events@keeponrunning.be. Until 15 days before the competition, the registration amount, less an administrative fee of 5 EUR, will be refunded in the form of a discount code for participation in a subsequent event. No more cancellations are possible during the last 2 weeks.

Article 8. Healthy & safe sports recommendations and COVID-19.

Participation requires good health and good conditional preparation. The participant declares to comply with this condition. The organizer recommends a preventive sports medical examination with a recognized sports doctor before participation. The organizer cannot be held responsible in case of medical problems of the participant.

The organizer has taken the necessary health and safety measures for the event. The participant declares to strictly follow the measures in force, which can be adapted at any time by the organizer to the circumstances and rules in force at the time.

The participant is recommended not to participate in the event in case of symptoms that may indicate COVID-19, such as feeling flu-like, fever, cough, shortness of breath, nasal discharge or unusual fatigue.

High-risk groups are discouraged from participating in the event.

Article 9. Personal data and intellectual property rights.

All participant information is intended for KEEP ON RUNNING. KEEP ON RUNNING and its partners will use this data for the participation of the Event as well as for marketing and communication purposes. The General Data Processing Regulation 2016/679 of April 27, 2016 i.v. the protection of privacy regarding data processing, provides the right to access and correct the data. The participant may at any time request correction of his personal data, via the contact details included in these general terms and conditions.

By participating in the event, you agree to any use of your data, photo or portrait rights in print, film, video etc. for promotional purposes of KEEP ON RUNNING and its events, without claiming compensation.

The participant acknowledges that techniques may be used that allow the tracking of his/her exact location at any time by picking up signals from the chip included in the proof of participation worn by the participant. The participant grants permission to KEEP ON RUNNING to disclose this information for all to see.

The participant grants permission to KEEP ON RUNNING to track his location in real time (live tracking) in a manner as described above, to record this data in a file, to provide it to third parties and to publish it via the Internet, via social media and via mobile applications. By entering into the agreement, the participant grants permission to the organizer to publish his name and race results.

Article 10. Comments/Complaints.

Comments should be submitted in writing at to the organizer via events@keeponrunning.be. The organizer will always make every reasonable effort to deal with any comment and within 10 days of receipt via one of the above-mentioned channels. If this is not successful, the participant will also be notified and an alternative timeframe will be proposed.

Article 11. Validity of clauses

If one or some articles of these terms and conditions should be void or illegal for any reason, this does not affect the validity of the other parts of the terms and conditions.

Article 12. Applicable law - jurisdiction

These general terms and conditions are governed by Belgian law. In the event of disputes relating to these general terms and conditions, the courts of the place where KEEP has its registered office shall have exclusive jurisdiction.

Privacy Policy

Privacy and processing of personal data

We collect and process personal data as part of our website, ticket sales, social media and at the relevant event. By accepting these terms and conditions, you agree to this privacy policy and expressly consent in writing to the collection and processing of personal data relating to you in accordance with the purposes described herein. We collect and process the following data, in the manner described below:
- Identification data. Data that allows you to register yourself and allows us to uniquely identify you from other users, such as your e-mail. During your registration and login as a result of ordering tickets, your name, first name, address, date of birth, language, gender, telephone number and other data may also be processed or collected by us;
- Explicitly stated data. We also process data expressly provided by you, either directly to us or through the social media profiles, or through websites and social media of our partners and events;
- Automatically collected data. In addition to the aforementioned data, we may also automatically collect and process data such as your IP address, geographical location, the type and operating system of your computer or cell phone, visit and the time and duration of your visit to pages and sections of our products and services;
- Cookies. We use cookies for the purpose of improving the operation and ease of use of our online services.

Your personal data may be passed on to our partners, suppliers and event organizers. Your personal data may be processed for the following purposes:
- To make the use in general of the services (website, ticket shop, ...) as secure, convenient and user-friendly as possible and to optimize the user experience of our services;
- to create content relevant to you and to offer information, promotions, products and services from us and from our partners and to integrate them with other information, promotions, products and services from third parties;
- to be processed for the purpose of advertising, marketing and direct marketing for the purpose of commercial and promotional promotions, products and services from us and our partners, suppliers and event organizers. You have the right to access and correct your personal data in question at any time. Final Provisions

Failure or delay by us in exercising any right under these terms and conditions or any contract or any provision of law shall not be deemed a waiver of that right, and shall not affect any other or further occurrence or impair any right or remedy with respect thereto or in any way affect or modify our or your rights under these terms and conditions or any contract.

If one or more clauses of these general terms and conditions are found to be null and void, this shall not entail the nullity of the other clauses or of these general terms and conditions in general; in such a case, the null and void clauses shall be changed into legally valid clauses that are in accordance with the legal effects intended by us at the time of acceptance of these general terms and conditions.

These general terms and conditions, all agreements and all legal relationships to which these general terms and conditions apply are governed by Belgian law. All disputes that may arise in connection with (the execution of) these general terms and conditions and all legal relationships to which these general terms and conditions apply shall be submitted exclusively to the competent courts of Antwerp.
